Terms and Conditions of Use Sparkle Well, Sound Medicine, Sally Mathrick

1. Introduction

These Terms and Conditions ("Terms") govern your access to and use of the Sparkle Well website (sparklewell.com.au), Sound Medicine and Sally Mathrick including any programs, courses, community features, downloads, and content offered by Sparkle Well ("we", "us", "our"). Sparkle Well is a trading name of Sound Medicine (Sally Mathrick), ABN 35876867583.

By accessing our website, creating an account, or enrolling in any Sparkle Well program, you agree to be bound by these Terms. If you do not agree, please do not use the website or enrol in our programs.

2. Nature of Our Services

Sparkle Well provides educational content, naturopathic guidance, and structured wellness programs relating to nutrition, naturopathic and lifestyle medicine, including but not limited to Shape Your Menopause, Alcohol Free in 14 Days, 21-Day Reset, and 5-day Change Fast).

2.1 The programs, courses, materials, and community features offered by Sparkle Well ("the Programs") provide general health, nutrition, naturopathic and lifestyle education and information. The programs are designed for general educational purposes. The programs do not constitute individualised medical, naturopathic, dietetic, or other professional health advice, diagnosis, nor treatment.

2.2 You should not disregard, delay, or discontinue any medical advice or treatment because of information received through the Programs. Our programs are general in nature. They are not intended to replace the relationship you have with your GP, specialist, or other qualified healthcare provider. You should consult your own doctor or healthcare provider before:

• starting any new program, particularly if you are pregnant, breastfeeding, or have an existing medical condition;

• making significant dietary, supplement, or lifestyle changes; and

• if you are taking prescribed medication (including but not limited to medication for weight management, diabetes, or hormone therapy).

2.3 You acknowledge that individual responses to dietary, nutritional, and lifestyle changes vary. Where the Programs reference specific practices, foods, supplements, or protocols, you are responsible for assessing their suitability for your own circumstances, including any interactions with existing medical conditions or medications, and for seeking guidance from your treating practitioner about these where relevant. We do not guarantee any specific health outcome, weight change, or symptom improvement. Individual results vary.

2.4 If you experience any adverse symptoms, or symptoms that concern you, during participation in a Program, you should seek prompt advice from a qualified health practitioner and should not rely on Program materials, community discussion, or peer input as a substitute for that advice.

2.5 To the maximum extent permitted by law, and without limiting any rights you have under the Australian Consumer Law that cannot be excluded, Sparkle Well's liability for any claim arising from your participation in the Programs is limited to the amount paid for the relevant Program.

2.6 No practitioner-client relationship. Participation in a Sparkle Well program does not, on its own, create a naturopath-client relationship between you and Sally Mathrick or any other practitioner. Where a practitioner-client relationship exists through individual consultations, it is governed by separate consent and terms specific to that service.

3. Eligibility and Health Screening

Some programs require completion of a health screening questionnaire and acknowledgment of the risks outlined in these Terms prior to enrolment. We may decline or defer enrolment where screening indicates the program is unsuitable for you or recommend you seek medical clearance first.

You must be 18 years or older to enrol in a Sparkle Well program.

For your and your baby’s safety we prefer that if you are pregnant or lactating you refrain from using the Programs.

4. Account Registration

You agree to provide accurate and current information when creating an account, and to keep your login details confidential. You are responsible for all activity that occurs under your account. Accounts are for individual use only and may not be shared.

5. Payment Terms

Program fees are quoted in Australian Dollars (AUD) and are payable either as a one-time payment or via an instalment payment plan, as selected at purchase/enrolment.

• Instalment plans are a binding commitment to pay the full program fee across the agreed schedule.

• We reserve the right to suspend program access if a scheduled payment fails and is not resolved within 10 days.

• We may change program pricing at any time; changes will not affect fees already agreed for an active enrolment.

6. Refunds and Cancellations

You may request a full refund within 30 days of enrolment. Refund requests outside this window are considered at our discretion.

If you have subscribed to a program with an added individual naturopathic consultation, the cost of any consultations you have received are not refundable.

We do not offer refunds for change-of-mind once the cooling-off period has passed, or for failure to complete a program within the access period.

7. Intellectual Property and Licence to Use

All program content, materials, videos, workbooks, and downloads remain our intellectual property. Enrolment grants you a personal, non-transferable licence to access and use the materials for your own private use.

You must not reproduce, resell, distribute, publicly share, or use program content for commercial purposes without our prior written consent.

8. Community Guidelines

Where a program includes access to a community forum or group:

• Content shared in the community is for peer support and general discussion only, and is not medical advice.

• We ask that members treat each other respectfully and do not share other members' personal information outside the group.

• We reserve the right to remove content or restrict access for members who breach these guidelines.

• Please do not use the community forums as a sales platform for products without an agreement in writing from us.

9. Testimonials and User Content Licence

From time to time, you may share feedback, testimonials, comments, forum posts, progress updates, screen shots or other content with us, whether directly (e.g. via email, survey, comments or questions) or through community features of a Program ("User Content").

9.1 Licence granted to us
By submitting User Content, you grant Sparkle Well a non-exclusive, royalty-free, worldwide, perpetual licence to use, reproduce, adapt, publish, and display that User Content — including in marketing materials, on our website, and across social media — for the purpose of promoting Sparkle Well's programs and services.

9.2 Attribution and anonymity
Where we use your User Content in marketing, we will use your first name and last initial only, unless you give us separate written consent to use your full name, photo, or other identifying details. You may request that identifying details be removed or replaced with a pseudonym at any time.

9.3 Withdrawing consent
You may withdraw this licence for future use at any time by notifying us at smile@soundmedicine.com.au. This will not affect material already published prior to your request, which we will make reasonable efforts to remove within 30 business days where practicable.

9.4 No obligation to use
We are under no obligation to use any User Content you provide, and reserve the right to edit testimonials for length or clarity without changing their substantive meaning.

9.5 Health-related content
Where User Content relates to your health outcomes or experience of a Program, you acknowledge this reflects your individual experience only, and we will avoid presenting it in a way that implies a guaranteed or typical outcome for other participants.

10. Limitation of Liability

To the maximum extent permitted by law, we exclude liability for any indirect, incidental, or consequential loss arising from your use of our services, website or participation in a program.

Nothing in these Terms excludes, restricts, or modifies any consumer guarantee, right, or remedy under the Australian Consumer Law that cannot lawfully be excluded.

11. Privacy

We collect and handle personal information in accordance with the Australian Privacy Principles under the Privacy Act 1988 (Cth). Health information is treated as sensitive information under the Act and is handled with additional care.

11.1 Program and community platform data
Information you provide when enrolling in a program or participating in community features (such as your name, contact details, and program activity) is hosted on a secured server governed by European Union privacy laws.

11.2 Health information collected in consultation
Personal health information collected during an individual naturopathic consultation is stored separately, on a secured drive that is not connected to or accessible via the cloud. This is held for the time frame required by law.

11.3 Your rights
You may request access to, or correction of, the personal information we hold about you at any time by contacting us at smile@soundmedicine.com.au.

12. Termination

We may suspend or terminate your access to the website or a program if you breach these Terms, engage in abusive conduct, or misuse program content.

13. Changes to These Terms

We may update these Terms from time to time. Continued use of the website or a program after changes take effect constitutes acceptance of the updated Terms. Material changes will be notified via email.

14. Governing Law

These Terms are governed by the laws of New South Wales, Australia, and you submit to the non-exclusive jurisdiction of the courts of that state.
